Let me tell you about a client of ours. Helen’s grandmother had recently passed away without leaving a will. She was a very generous lady and told everyone before she passed on that she had left them all something. The problem is that she hadn’t made out a will. After her death, no-one knew how to carry out her wishes and so sorting out her estate was very complicated.
Don’t let this happen to you
We all assume it will be easy to sort out what we have after we die – there are loads of myths out there such as our money goes to our next of kin – are you sure it will?
So, why should you make a will at all? Great question! Here are some reasons why making a will is a good idea:
· It reduces the hassle for those that are left behind – remember they won’t be in the best frame of mind to deal with everything. Making a will makes it much easier for them.
· To make sure your children and your loved ones are looked after. If your children are under 18, you’ll need to appoint some legal guardians for them and make arrangements to provide financial support for them. Make sure your wishes are carried out by making a will.
· To save inheritance tax. Taking some advice will allow you to pay much less. Just by carefully constructing your will, you will be able to reduce the bill significantly.
· To protect your assets. You may have everything very clearly laid out in your head, but if no-one knows about your wishes, your assets may not go to where you want them to.

What is a power of attorney?
A power of attorney is very similar to a will except that where a will manages your affairs if you die, a power of attorney manages your affairs if you are incapacitated.
If, at some point in the future, you suffer from some illness, dementia or injury that leaves you unable to manage your own affairs, then life can become very frustrating for those trying to care for you, particularly if they need to sell your house or cash-in your savings and investments to pay for your care. Even the daily chore of collecting pensions and paying bills can become impossible if nobody has the authority to represent you.
A power of attorney clears the way for those that you’ve appointed to deal with your financial affairs easily, making their life much less difficult. And, it’s much better than the alternative which is to place you under the control of the Court of Protection, meaning that your affairs will be managed by a “Deputy” appointed by the Court.

Why make a will: Looking after the children
If you have children under 18, you need to appoint legal guardians to look after them and you need to make arrangements to provide financial support for them.
